Welcome to Modistica. By using this website or placing an order, you agree to these terms.
1. Our store
Modistica is a prom and formal dress boutique located in Fort Lauderdale, Florida, selling online to customers in the United States. Every dress listed as in stock is physically in our boutique.
2. Products and pricing
We do our best to display each dress accurately, but colors may vary slightly between screens and in person. Prices are in US dollars and may change without notice. We reserve the right to correct pricing or listing errors and to cancel an order placed at an incorrect price, with a full refund.
3. Orders and payment
An order is accepted when we send your confirmation email. We may decline or cancel an order for reasons including stock errors, suspected fraud, or payment problems, and will refund any amount paid. Payment is processed securely by Shopify Payments; we do not store card details.
4. Shipping
Shipping terms, costs, and delivery estimates are set out in our Shipping Policy, which forms part of these terms.
5. Returns and exchanges
Returns are governed by our Return and Refund Policy, which forms part of these terms. Sale items and special orders are final sale.
6. Accounts and communication
If you create an account, you are responsible for keeping your login secure. By providing your email or phone number you agree to receive order-related messages. Marketing messages are sent only if you opt in, and you can unsubscribe at any time.
7. Intellectual property
The Modistica name, logo, and website content belong to Modistica or are used with permission from our designers. Product photography is the property of the respective designers and is used under our authorized retailer agreements. Nothing may be copied or reused without written permission.
8. Limitation of liability
To the fullest extent permitted by law, Modistica is not liable for indirect or consequential losses arising from use of this website or from a purchase. Our total liability for any order is limited to the amount paid for that order.
9. Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the courts of Broward County, Florida.
10. Changes
We may update these terms at any time. The version in force when you place an order applies to that order.
